The terms and conditions set forth in this agreement explain your rights and obligations, the Customer (user), and us (Sonali Bank Limited), in connection with your use and our services related to eWallet. All terms and conditions of this agreement are legally binding, so we advise you to please read them through carefully. .

  1. DEFINITIONS
In this Agreement, the following words shall have the respective meanings set out hereunder unless the context otherwise requires:
  • Bank means Sonali Bank Limited, its successors and assigns.
  • Agreement means the 'Terms and Conditions' along with Sonali Bank VISA Debit Card Application Form.
  • ATM means any Automated Teller Machine or Terminal belonging to the bank that accepts cards along with PIN for cash withdrawal.
  • Card means any Card bearing the name of Sonali Bank Limited issued to the Account holders for use on their Accounts and includes any such issued in replacement or renewal thereof, to avail cash withdrawal services or POS transactions.
  • Sonali Bank Debit Card means valid VISA Cards issued by Sonali Bank PLC.
  • PIN in relation to any Card means Personal Identification The number assigned by Sonali Bank to that Card that will be used for accessing the Cardholder’s nominated bank Account(s) through an ATM.
  • Cardholder where used in raltion to a Debit Card means Sonali Bank Account holder to whom Debit Card has been issued at his / her request.
  • Customer means the Account holders of Sonali Bank stated above.
  • Card Transaction means any transaction or instruction effected or issued by the cardholder by the use of the card.
  1. ABOUT THE CARD
  • Sonali Bank Visa Debit Card' is the property of the Bank at all times. It is non-transferable and will be used exclusively by the Cardholders.
  • The Bank reserves the right to seize/cancel the card so issued to any cardholder if the information submitted by the Cardholder is false and/or the card is being misused if found at a later date.
  • The Bank reserves the right to limit the total cash withdrawal or goods and services purchased at Visa authorized merchants by the cardholder during a 24 hour period.
  • Upon termination of account relationship with Bank for any reason whatsoever, the Card shall be returned to the respective branch or Sonali Bank Card Division within 7 (seven) days from the date of receipt of notice thereto.
  • Use of the Card after notice of withdrawal of the privileges is fraudulent and may subject the Cardholder(s) to legal action by the Bank.
  1. FACILITIES THAT CAN BE AVAILED WITH SONALI BANK DEBIT CARD
  • The Card can be used for: Availing Cash withdrawals from Sonali Bank Branch locations or the places where Sonali Bank ATMs are deployed. ATM Establishment displaying the Visa Logo and Q-Cash Member Banks ATM Locations or POS transactions for goods and services obtained from Visa authorized merchants in Bangladesh by the use of the Card.
  1. LOSS OF CARD OR DISCLOSURE OF PIN
  • The Cardholder shall not disclose the PIN to anyone. The Cardholder will be liable to the Bank for any and all transactions made by the use of the Card and hereby agrees to indemnify the Bank for any losses or damages howsoever caused by any unauthorized use of Card or PIN, unless the Bank has received notice in writing of any loss, damage, or theft of the Card or disclosure of the PIN prior to any unauthorized use of the Card or PIN for this purpose, use of the Card by a person who obtained possession of the Card with the consent of the Cardholder constitutes authorized use to the Card.
  • Notwithstanding the loss or theft of any Card or disclosure of the PIN in respect of any Card, the Bank may charge and debit the Account for the amount of each and every Card Transaction made or affected before written confirmation by the Cardholder of such loss, theft or disclosure is received by the Bank. Replacement of Card will be provided to the Cardholder and charges in this regard will be debited from the account.
 
  1. FEES AND CHARGES:
The bank will charge and debit the customer's Account relating to any Card-
  • An annual service fee and VAT for the issue or renewal of the Card at such rate as the Bank may prescribe from time to time without notice.
  • In the event of replacement of the card due to whatever reasons as requested by the cardholder, a replacement fee will be charged to the account as prescribed by the Bank management.
  • In the event of resetting the PIN, a fee will be charged to the account.
  1. TERMINATION OF USE OF CARD AND ACCOUNT
The Card shall not be valid and the Bank shall be entitled to the immediate return of the Card in the event of
  • Closure of the Designated Account,
  • Death of the Account/Card holder,
  • The Cardholder's authority to operate the Designated Account is terminated,
  • The Cardholder ceases to be a customer of the Bank,
  • The Bank requests for its return.
 
  1. EXCLUSIONS AND EXCEPTIONS
Sonali Bank shall not be responsible or liable for any and all cardholder for any loss or damage incurred or suffered as a consequence of:
  • Any malfunction, defect, or error in any ATM, or other machines or system of authorization whether belonging to or operated by the Bank or otherwise.
  • Any delay or inability of the Bank to perform any of its obligations pursuant to this Agreement because of any mechanical, data processing, or telecommunication failure. Act of God, civil disturbance, or any event outside of the bank's control or as a consequence of any fraud or forgery.
  • Any damage to or loss of or inability to retrieve any data or information that may be stored in any Card howsoever caused.
  • Any undesired fraud and forgery by means of computer hacking or any means that cause any burden to the Cardholder.
  1. DISCLOSURE OF INFORMATION
Card Services of the Bank may disclose any information relating to any cardholder for any card account or card transaction to the Bank authority any regulatory body or any other person if the Bank considers its interest to do so.
  1. MISCELLANEOUS
  • All rules and regulations governing the operations of current and savings accounts will be applicable to the Card transactions relating to such accounts.
  • The Bank may at any time change terms and conditions without prior notice to the Cardholder.
  • These Terms and Conditions will stand amended if such amendments are necessitated by law, government regulations, or instructions issued by the Bangladesh Bank.
  • All notifications and/or questions concerning the use of the Card should be directed to the Branch Manager of the Cardholder's branch or the Card Division.
  • The cardholder will not use this card for any illegal transaction or anything unlawful, under the laws of Bangladesh.
  • All disputes are subject to the jurisdiction of courts in Bangladesh only.
  • In case of any disputes, notify the designated Branch within 45 (Forty-Five) days.
  1. DECLARATION
  • I do hereby acknowledge that I have read and understood the above terms and conditions and agree to comply with them.

POSITIVE PAY INSTRUCTION

The Bank will use commercially reasonable efforts to comply with your Positive Pay Instruction. However, the Bank will not be liable for any losses you suffer due to:

  • Errors or omissions in the information you provide in your Positive Pay Instruction.
  • Delays in processing your Positive Pay Instruction
  • The Bank's inability to verify the details of a presented cheque due to reasons beyond the Bank's control
  • Fraudulent activity on your account that is not detected by the Positive Pay Instruction service
  • Verify the details of any cheque presented for payment against the information you provide in your Positive Pay Instruction.
  • Refuse to pay any cheque that does not match the authorized details in your Positive Pay Instruction.
  • Notify you if the Bank cannot verify the details of a presented cheque.


Terms and Conditions for Digital Nano Loan

Introduction

These Terms and Conditions (Terms) govern the rights and obligations of the Customer (hereinafter referred to as the Customer or Borrower or customer) and Sonali Bank PLC (hereinafter referred to as SBPLC or the Bank) in connection with the application, sanction, and usage of the Digital Nano Loan facility. By applying for or availing the Digital Nano Loan through mobile application (Sonali e-Wallet), customer acknowledge that customer have read, understood, and agreed to be bound by these Terms and all other terms of Sonali e-Wallet. These Terms are legally binding and enforceable under the applicable laws of Bangladesh. Where applicable, these Terms shall be read in conjunction with the Bank’s general terms and conditions governing credit facilities and digital banking (Sonali e-Wallet).  

Definition

If there is nothing contrary to the subject or context, this terms and conditions shall be deemed effective-
  • Sonali e-Wallet means-- digital mobile apps/platform made by the bank.
  • Digital Nano Loan means-- the loan which is digitally disbursed, repayment and closed through Sonali e-Wallet.
  • Digital Signature means-- digital consent or confirmation or acceptance by the customer for acknowledging all terms and conditions applied for Digital Nano Loan and Sonali e-Wallet.
  • Primary Account means-- Individual Savings/Current account by which Sonali e-Wallet is registered.
  • Bank Circular means—an official notification or directive issued by a bank’s authority to guide, inform, or instruct its branches, employees, or customers about policies, procedures, rules, or changes in banking operations.

Scope and Applicability

  • These Terms are to be applied exclusively to Digital Nano Loan facilities sanctioned by Bank against those customers who are eligible.
  • These Terms are supplementary, and do not override, the Bank’s General Terms and Conditions governing loans and credit products and digital banking service offered through Sonali e-Wallet.
  • In case of any conflict or inconsistency, these Terms shall prevail in matters related to the Digital Nano Loan.

Category of Eligible Customers

Individuals engaged in the following professional categories are eligible for this loan:
  • Bank Officers and staffs,
  • Teachers of government and private schools, colleges, madrasas and universities who receive salaries from this bank,
  • Freedom fighter receiving allowance,
  • Pensioners whose pension money is deposited in this bank.
  • Customers who receive monthly/quarterly profits/benefits from any profit-making scheme/bills/bonds authorized by Bangladesh Bank/Government/bank to his/her Primary Account of the bank.
The customer base for this loan will be expanded in phases later.
Loan Eligibility and Approval Requirements
  • The customer shall maintain a regular savings account with any branch of the Bank in which a particular amount of money has to be deposited/credited on monthly basis.
  • The customer must be employed by a company that has a contractual agreement with the Bank to provide this loan facility.
  • Re-application of loan will not be accepted if the customer has a loan of the same nature existing.
  • The customer must meet the minimum threshold of 50% on the bank’s prescribed Loan scoring system. In this regard, Bank follows a standard scoring procedure which will be maintained by system automatically.
  • The score calculated and the loan limit determined by the system will be treated as final. The customer shall not be entitled to raise any objection or challenge in this regard.
  • The customer must not have any classified or non-performing loans at the time of application.
  • A nominee must be appointed to his/her Primary account maintained with the bank.
  • The customer’s savings account must comply fully with KYC requirements and related compliances.
  • The Primary Account must be active and in good standing.

Term of loan

The loan tenor shall be determined in accordance with the Bank's prevailing policies, guidelines, and circulars, and shall be subject to revision from time to time at the sole discretion of the Bank without prior notice.

Collection/Payment/Re-Payment Method

  • The customer undertakes to ensure the punctual monthly servicing of all loan installments, adhering strictly to the agreed repayment schedule.
  • The customer may make partial or full prepayments at any time, at their discretion, without any restriction.
  • Repayment must be made via Sonali e-Wallet.

Loan Type

The facility is sanctioned as a Term Loan under the purview of the General Advances Division of the Bank.

Interest, Charges, Penalty and Taxes

  • Interest: The interest rate which will be determined by the bank may change time to time.
  • Penalty: In case of overdue, additional interest may be applied and may vary following the bank circular.
  • Charges: CIB Charge (non-refundable), supervision charge and other charges may be applied if require by Bangladesh Bank/the Bank’s circular.
  • Taxes: Excise Duty, and other taxes may apply as per government circulars.

Customer Rights and Responsibilities

Customer Rights:

  • Right to Transparent Information: Customers have the right to receive clear, concise, and accurate information regarding loan terms, applicable fees, interest rates, repayment schedules, and any associated charges prior to loan acceptance.
  • Right to Data Privacy and Protection: Customer data shall be collected, stored, and processed in compliance with applicable data protection regulations in Bangladesh. No personal or financial information will be disclosed without the customer’s consent, except as required by law.
  • Right to Fair and Non-Discriminatory Access: All customers are entitled to equal access to digital financial services without any discrimination based on gender, religion, ethnicity, or socio-economic background.
  • Right to Raise Complaints and Seek Redress: Customers reserve the right to lodge complaints through the digital platform’s in-app support system or via designated customer service channels. All complaints shall be addressed within a stipulated turnaround time as per regulatory guidelines.

 Customer Responsibilities:

  • Duty to Provide Accurate and Verifiable Information: Customers are obligated to provide true, accurate, current, and complete information during onboarding and loan application processes. Misrepresentation may result in rejection or cancellation of the loan.
  • Timely Repayment Obligation: Customers are responsible for repaying the loan in full and on time as per the approved repayment schedule. Failure to repay may result in additional charges, digital recovery measures, or legal action in accordance with the bank’s policies.
  • Appropriate Usage of Disbursed Loan: Customers must utilize the loan for lawful and permissible purposes only. Usage of funds for illegal or unethical activities is strictly prohibited and may lead to service termination and legal proceedings.
  • Maintaining Updated Contact Information: Customers must ensure that their mobile number, email address, and KYC-related details remain accurate and up to date throughout the tenure of the loan.
  • Cooperation During Digital Verification and Monitoring: Customers are required to cooperate with any digital verification, monitoring, or audit process undertaken by the bank or regulatory authorities for credit assessment, fraud prevention, or compliance purposes.

Bank Rights and Liabilities

The Bank reserves the right for:
  • Modification, cancellation, or recalling the Digital Nano Loan at its discretion;
  • Suspension or blocking access to the limit if documentation found invalid;
  • Denial to renewal or re-sanctioning upon expiry.
The Bank shall not be held liable for:
  • Customer’s misuse of loan or misrepresentation of information;
  • Losses due to Customer’s negligence or breach of Terms;
  • System downtime or mobile channel inaccessibility;
  • Damages caused by force majeure, including legal or regulatory actions.

Technical Error

Due to potential technical disruption, security threats and/or disaster, bank is not liable for non-receiving of any Email/SMS notification (regarding sanction/disbursement/ expiry/closure) related to this Digital Nano Loan.

Termination/Closure and Default

Default occurs in case of:
  • Non-repayment of interest/principal;
  • Breaches of any term herein;
  • Initiation of insolvency or legal proceedings.
In such events, the Bank may:
  • Recall/adjust the entire loan outstanding forcefully by using any account balance maintain by his/her in the Bank
  • Report the default to Loan Information Bureau (CIB) as per regulation.
Closure of the loan by either customer is subject to full payment of all outstanding dues, including any accrued or unapplied interest and applicable charges.

Legal and Regulatory Compliance

  • The Customer must not use the Digital Nano Loan for unlawful purposes including money laundering or speculative activity.
  • These Terms are governed by the laws of Bangladesh and subject to regulatory oversight of Bangladesh Bank.
  • Any dispute shall fall under the exclusive jurisdiction of the courts of Bangladesh.

Acceptance

By submitting a formal application or providing digital consent through Sonali e-Wallet, the Customer confirms that they have read, understood and accepted these Terms and Conditions. The Customer further acknowledges that Bank, its employees, or agents shall not be liable for any loss, damage, or claims arising from use of the Digital Nano Loan except in cases of proven gross negligence or willful misconduct on the part of the Bank.
